Terms of Use

1. Scope and Acceptance

These Terms of Use ("Terms") govern your access to and use of the finqt mobile application, related backend services, APIs we make available through the app, alerts, educational content, AI features, subscription features, and related services we operate under the finqt brand (collectively, the "Services"). The Services are offered by Finqt LLC-FZ ("Finqt", "we", "us", or "our"), established in Meydan Free Zone, Dubai, United Arab Emirates.

By downloading, installing, creating an account, accessing, or using any part of the Services, you agree to these Terms and to our Privacy Policy, Data Privacy notice, Cookie & Tracking Policy, Disclaimer, Acceptable Use Policy, and Refund Policy, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not use the Services.


2. Changes to the Services and These Terms

We may update these Terms or modify the Services from time to time to reflect product changes, billing changes, operational controls, legal requirements, or security needs. The latest version will be made available through the Services and will indicate the revised effective date.

If a change materially affects your rights or obligations, we may provide additional notice in the app, by email, or through another reasonable method. Your continued use of the Services after the updated Terms take effect means you accept the updated Terms. If you do not agree, you must stop using the Services.

We may add, remove, suspend, limit, or redesign features at any time, including AI tools, price alerts, watchlists, content modules, or paid entitlements.


3. Eligibility and Minors

To use the Services, you must:

  • be at least 13 years old
  • not be prohibited from using the Services under applicable law
  • have the legal capacity to enter into these Terms, or, if you are under the age of majority where you live, use the Services only with the supervision and consent of a parent or legal guardian

The Services are not directed to children under 13. If you are a parent or guardian allowing a minor to use the Services, you are responsible for the minor's use of the Services, purchases, and compliance with these Terms.


4. What the Services Are

finqt is a financial-information, education, and productivity platform. Depending on your plan, region, language, device permissions, and feature availability, the Services may include:

  • real-time or delayed market data, charts, watchlists, favorites, and alerts
  • news, market commentary, summaries, educational content, and learning modules
  • AI chat, market explanations, and image-based analysis of user-submitted chart screenshots or similar materials
  • personal trading notes, rules, journals, mood entries, bookmarks, and related sync features
  • push notifications, in-app notifications, and session-management tools
  • subscriptions, credits, top-ups, promotional offers, and other digital entitlements

The Services are not a brokerage account, exchange account, or trading venue. We do not execute trades, hold custody of your money or assets, clear transactions, or route orders on your behalf.


5. No Financial, Legal, Tax, or Professional Advice

The Services are provided for informational and educational purposes only.

Nothing in the Services constitutes, or should be relied on as:

  • investment advice or investment recommendations
  • personalized financial planning or suitability analysis
  • legal, tax, accounting, or regulatory advice
  • a solicitation, endorsement, or recommendation to buy, sell, hold, or enter into any transaction or strategy
  • a representation that a trade, strategy, alert, or idea is appropriate for your personal objectives, risk tolerance, resources, or legal situation

You remain solely responsible for your decisions, actions, and outcomes. You should consult qualified professional advisers before making investment, legal, tax, or other material decisions.


6. Market Data, News, Research, and Educational Content

The Services may display, summarize, or distribute market data, charts, news, commentary, educational materials, public filings, social signals, sentiment indicators, and research generated from third-party sources.

You acknowledge that:

  • market data may be delayed, partial, unavailable, stale, or inaccurate
  • exchange, broker, or venue prices may differ from prices shown in the Services
  • news and commentary may contain errors, omissions, bias, or outdated conclusions
  • educational content is general in nature and may not reflect your personal circumstances or current market conditions
  • we do not independently verify every external source, feed, article, or statement

You must independently confirm material information before relying on it.


7. AI Features and AI Output

The Services may include AI-powered features such as chat, summaries, explanations, prompt suggestions, image analysis, and generated observations.

You acknowledge and agree that:

  • AI output may be inaccurate, incomplete, inconsistent, biased, offensive, or outdated
  • AI output is generated probabilistically and may vary for similar requests
  • AI output may omit important facts, risks, exceptions, or changing market conditions
  • AI output is not professional advice and must not be your sole basis for trading, investing, legal, tax, or compliance decisions
  • your prompts, chat messages, images, and related inputs may be processed by third-party AI providers to generate responses
  • we may apply safety filters, moderation, throttles, quotas, credit multipliers, and rate limits to AI features

If you upload a chart screenshot, photo, or other image, you confirm you have the right to provide that material for processing and that it does not violate another person's rights or applicable law.


8. Alerts, Notifications, and Device-Dependent Features

The Services may let you configure price alerts, receive push notifications, in-app notifications, email notices, or other event-driven updates. These features depend on device settings, network availability, third-party infrastructure, operating-system behavior, and your permissions.

We do not guarantee that any alert or notification will be:

  • delivered at all
  • delivered only once
  • delivered on time
  • accurate or complete
  • sufficient for your trading, investing, or monitoring needs

Alerts and notifications are convenience features only and are not a substitute for your own monitoring or risk controls.

You are solely responsible for setting appropriate alert thresholds, maintaining device permissions, monitoring your positions or markets of interest, and keeping alternative monitoring processes if a delayed or missed alert could cause you harm. The Services do not include a guaranteed failover channel, guaranteed message queue, or guaranteed escalation path if a push provider, operating system, network, or device setting prevents timely delivery.


9. Accounts, Credentials, and Security

You may need an account to use some features. You agree to provide accurate, complete, and reasonably current information.

You are responsible for:

  • maintaining the confidentiality of your credentials and device access
  • all activity under your account unless caused by our breach of these Terms or applicable law
  • promptly notifying us of suspected unauthorized access, credential compromise, or misuse
  • keeping your app, device software, and security settings reasonably current

You may not:

  • create an account using false or misleading information
  • impersonate another person or entity
  • sell, rent, lease, share, or transfer your account
  • attempt to bypass authentication, session controls, credit controls, or security restrictions

We may require verification, revoke sessions, limit concurrent access, or suspend access where we reasonably suspect fraud, abuse, policy violations, or security risk.


10. User Content, Inputs, and Feedback

You may create, upload, store, or submit content through the Services, including profile information, notes, rules, mood entries, tags, alerts, images, prompts, feedback, and support communications (collectively, "User Content").

You retain ownership of your User Content, but you grant Finqt a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, synchronize, transmit, display, and otherwise process that User Content as reasonably necessary to:

  • provide and operate the Services
  • sync data across your devices and sessions
  • provide AI outputs or other requested functionality
  • maintain security, investigate abuse, and enforce our Terms and policies
  • improve product reliability, moderation, and support operations

You represent and warrant that:

  • you have the rights and permissions necessary to submit the User Content
  • your User Content does not violate law or another person's rights
  • your User Content does not contain malware, unlawful instructions, or prohibited material

Do not submit confidential third-party information, personal data you do not have authority to share, or material you do not want processed through the Services.

If you provide feedback, ideas, or suggestions, you grant us the right to use them without restriction or compensation to you.


11. Paid Features, Subscriptions, and Credits

Some features require payment, a recurring subscription, one-time credit top-up, or the use of credits. Pricing, plan names, included features, quotas, and credit amounts are displayed in the app or relevant storefront at the time of purchase.

11.1 Subscription plans

The Services currently offer the following subscription tiers. Exact pricing, included credits, and feature scope may change over time and are confirmed at the point of purchase in the app or storefront.

Free tier — available at no cost. Includes a limited monthly AI credit allocation (currently 0 credits per month) and a limited number of free AI chat messages per rolling 24-hour period (currently 0). Free-tier users have restricted quotas for alerts, watchlist assets, and other features as disclosed in-product.

Pro tier — a paid auto-renewable subscription available on a monthly or annual billing cycle. Currently includes 100 AI credits per month, real-time market data, market intelligence features, unlimited alerts, unlimited watchlist assets, and push-notification support.

Pro+ tier — a paid auto-renewable subscription available on a monthly or annual billing cycle. Currently includes 300 AI credits per month and all Pro features, plus priority support and data-export capabilities.

Annual plans are billed as a single upfront payment for the full year and may reflect a discount compared to 12 months of the corresponding monthly plan. The exact discount, if any, is shown at the time of purchase.

All paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date through the relevant storefront. Prices displayed in the storefront are set in the storefront's currency and may vary by region.

11.2 Platform billing

If you purchase through Apple App Store or another platform storefront:

  • your payment relationship is primarily with that storefront
  • recurring subscriptions renew automatically unless cancelled before the renewal date
  • that storefront controls billing timing, payment collection, refund handling, and some entitlement records
  • we rely on platform verification records to confirm subscriptions, top-ups, restores, revocations, and refunds
  • to the maximum extent permitted by law and platform rules, all sales are final and we do not provide voluntary or convenience-based refunds for delivered digital entitlements

11.3 AI credits — types, allocation, and consumption

The Services use a credit-based system for AI features. There are two types of credits:

Subscription credits (base credits) are allocated monthly as part of a paid subscription. They reset at the start of each billing cycle. Unused subscription credits do not roll over to the next period — any remaining subscription credits at the end of a billing cycle are forfeited.

Purchased credits (top-up credits) are acquired through one-time in-app credit packages. They are added to your account balance upon purchase, do not expire, and persist until consumed. Top-up credit packages are currently available in the following sizes (exact pricing confirmed at the point of purchase):

  • Small package (currently 20 credits)
  • Medium package (currently 50 credits)
  • Large package (currently 150 credits)

Credit consumption rates vary by feature:

  • Standard AI text message: 1 credit per message
  • Image analysis (chart screenshot or photo analysis): 2 credits per request

When both credit types are available, purchased (top-up) credits are consumed first, followed by subscription (base) credits. This means your subscription credits are preserved as long as purchased credits remain in your account.

Credits from all sources:

  • have no cash value and are not redeemable for money or property
  • are non-transferable and non-sublicensable
  • may be limited by subscription tier, promotion, time period, abuse controls, or other operational rules disclosed in-product
  • may be revoked, reduced, or adjusted if a related payment is refunded, charged back, reversed, or found to be fraudulent

11.4 Delivery and consumption

For refund and entitlement purposes, a digital credit or AI entitlement may be treated as delivered once it is made available to your account, and it may be treated as consumed once:

  • a request is accepted for processing
  • compute resources are allocated
  • an AI response is generated, streamed, or otherwise delivered
  • an image-analysis or similar job begins execution

You acknowledge that for paid digital services, delivery can occur by activation, provisioning, availability in your account, or commencement of processing, and not solely by extended continued access.

IMPORTANT — AI CREDITS ARE NON-REFUNDABLE ONCE USED. Once an AI credit is consumed — meaning a request has been accepted for processing, compute resources have been allocated, or an AI response has been generated or streamed — that credit is permanently spent and cannot be refunded, reversed, or restored. This applies to both subscription credits and purchased top-up credits, and regardless of whether you are satisfied with the AI output. By purchasing or using AI credits, you acknowledge and accept that consumed credits are non-refundable except where mandatory law or binding platform rules require otherwise.

11.5 Promotions and trials

We may offer trials, discounts, coupons, bonus credits, or promotional entitlements subject to additional terms presented at the time of the offer. We may withdraw or modify promotions where permitted by law.

11.6 Taxes, foreign-exchange effects, and third-party charges

Unless expressly stated otherwise, displayed prices do not include every tax, bank fee, foreign-exchange conversion spread, telecom charge, or third-party platform fee that may apply to your purchase or use of the Services. Your bank, card issuer, mobile platform, or tax authority may impose additional charges, and exchange-rate conversion may affect the final amount you pay.

You are solely responsible for determining whether any taxes apply to your purchase or use of the Services and for reporting or paying any taxes legally due from you.

11.7 Platform account responsibility and restore limitations

Subscription status, restore functionality, and entitlement recovery may depend on your continued access to the storefront account used to make the purchase. If you lose access to that platform account, switch storefront regions, use multiple Apple IDs, or restore into the wrong finqt account, recovery may be delayed or unavailable until identity and purchase mapping are resolved.

We may require reasonable evidence before manually reviewing entitlement mismatches, including a transaction identifier, screenshot, renewal receipt metadata, or similar proof.


12. Refunds, Chargebacks, and Reversals

Refunds are governed by our Refund Policy, which forms part of these Terms.

Without limiting that policy:

  • to the maximum extent permitted by law, all sales are final and we do not provide voluntary, goodwill, prorated, convenience-based, or partial refunds for paid digital features, subscriptions, or credits
  • platform-billed purchases must generally be refunded through the relevant storefront
  • we cannot independently approve, deny, or override Apple refund decisions for App Store purchases
  • if a payment is refunded, charged back, reversed, revoked, or found to be fraudulent, we may revoke or reduce associated entitlements, credits, or access
  • if refunded credits were already consumed, we may offset future credits, suspend paid features, or otherwise adjust your account to reflect the reversal, to the extent permitted by law and platform rules

Consumed AI credits and tokens are non-refundable. You agree that use of AI credits, top-ups, or similar digital entitlements after delivery materially reduces or eliminates any basis for a discretionary refund from us, except where mandatory law or binding platform rules require otherwise.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.


13. Advertising, Sponsorship, and Promotions

The Services may contain sponsored content, paid placements, promotions, or advertising. Free or lower-tier experiences may include different promotional surfaces than paid tiers.

Your dealings with third-party advertisers, sponsors, or promoted services are solely between you and that third party. We are not responsible for third-party offers, statements, products, or services.


14. Acceptable Use and Prohibited Conduct

Your use of the Services is also governed by our Acceptable Use Policy. Without limiting that policy, you must not:

  • use the Services for unlawful, fraudulent, abusive, or deceptive conduct
  • scrape, crawl, benchmark, copy, mirror, frame, archive, harvest, or systematically extract data, content, prompts, outputs, layouts, workflows, or other material from the Services
  • use automation, bots, or scripts to overwhelm, manipulate, or bypass the Services
  • reverse engineer, decompile, disassemble, decode, probe, emulate, instrument, intercept, or attempt to discover source code, object code, model-routing logic, prompt structure, safety systems, hidden interfaces, ranking methods, feature weights, security controls, or internal architecture except where applicable law prevents such restrictions
  • upload harmful files or attempt to bypass safety, moderation, quota, or credit controls
  • use the Services for market manipulation, sanctions evasion, rights violations, or similar misconduct

The preceding list is not exhaustive. You also may not use the Services to:

  • test, benchmark, or compare AI or market-data output for publication in a way that could mislead users about our capabilities or limits
  • republish, repackage, relabel, launder, white-label, or present premium, curated, or generated content as if it originated from you, your organization, or another unauthorized source
  • mask abuse through disposable accounts, VPN rotation, emulator farms, or similar evasion methods
  • extract, reconstruct, infer, or copy commercially valuable aspects of the Services, including taxonomies, prompts, response patterns, market-content packaging, editorial selection logic, recommendation logic, or product decisioning
  • use screenshots, recordings, exported text, copied outputs, or repeated querying to steal, approximate, rebuild, substitute for, or compete with the Services or any part of them
  • use the Services to obtain or derive trade secrets, confidential know-how, non-public product behavior, or internal operational logic for any unauthorized purpose
  • use the Services in a manner that could expose us, our providers, or other users to malware, phishing, social engineering, coordinated manipulation, or regulatory risk

We may investigate violations and take action without prior notice where reasonably necessary.


15. Intellectual Property and Limited License

The Services, including software, interfaces, design, text, graphics, branding, compilations, and original content, are owned by Finqt or our licensors and are protected by applicable intellectual-property and unfair-competition laws.

The Services are licensed, not sold. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services for your personal or internal lawful use.

Except for that limited license, no right, title, or interest in the Services is transferred to you. The Services embody protectable intellectual property, confidential business information, compilation rights, trade dress, database rights where applicable, proprietary workflows, and commercially valuable know-how.

You may not:

  • reproduce, distribute, publicly display, republish, or commercially exploit the Services or our content except as expressly permitted
  • use our names, logos, screenshots, or brand assets in a misleading way
  • transfer, redistribute, sublicense, rent, lease, lend, sell access to, or make the Services available over a network for unauthorized multi-user exploitation
  • build, train, benchmark, validate, seed, fine-tune, or improve a competing product, dataset, model, workflow, or internal tool using the Services or our content without our written permission
  • copy, misappropriate, steal, or make unauthorized derivative use of the Services, our outputs, our data arrangement, our interface structure, or our product logic
  • use any output, screenshot, recording, or extracted material from the Services to replicate the look and feel, sequencing, commercial logic, or economically material functionality of the Services
  • remove, obscure, bypass, or alter proprietary notices, technological protection measures, access restrictions, or attribution

Any unauthorized extraction, reuse, reverse engineering, theft, misappropriation, or competitive exploitation of the Services or their outputs may cause irreparable harm for which monetary damages may be inadequate. We reserve all rights and remedies available at law and in equity, including injunctive relief, emergency relief, account restrictions, evidentiary preservation, and claims for misuse of confidential information or proprietary know-how where applicable.

Your license to use the Services terminates automatically if you materially breach these Terms, without limiting any other remedy available to us.


16. Third-Party Services and Apple-Specific Terms

The Services may rely on or interoperate with third-party services, including Apple, Google, AI providers, market-data providers, hosting providers, notification services, and external content sources. We do not control those third parties and are not responsible for their availability, content, security, or separate terms.

If you use the iOS app:

  • these Terms are between you and Finqt, not Apple, except where law or Apple's standard platform rules require otherwise
  • Apple is not responsible for the Services, their content, maintenance, or support except as required by law
  • to the maximum extent permitted by applicable law, Apple has no warranty or maintenance obligation with respect to the app
  • Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS app and may enforce those Terms against you

You must also comply with any applicable platform usage rules and device terms.


17. Suspension, Restriction, and Termination

You may stop using the Services at any time.

We may suspend, restrict, or terminate access immediately, with or without notice, if we reasonably believe:

  • you violated these Terms or our policies
  • your use creates legal, regulatory, financial, security, or reputational risk
  • your account appears compromised or involved in abuse or fraud
  • we are required to do so by law, court order, regulator, platform rule, or governmental request
  • continued operation of a feature is no longer commercially or operationally feasible

Termination or account deletion does not automatically cancel a platform-billed subscription. Those subscriptions must be managed through the relevant storefront unless that storefront or applicable law provides otherwise.

If we suspend or restrict access for abuse, fraud, security, or legal-compliance reasons, we are not required to restore access while an investigation remains open. We may preserve relevant logs, prompts, uploads, credit ledgers, billing records, and security evidence as reasonably necessary to investigate the issue, enforce our rights, comply with law, or respond to disputes.

Where appropriate and reasonably safe to do so, we may allow you to contact us to request review of an account action. A review request does not guarantee reinstatement, restoration of credits, or reversal of moderation or security decisions.


18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AVAILABILITY, AND COMPATIBILITY.

Without limiting the foregoing, we do not warrant that:

  • the Services will be uninterrupted, secure, or error-free
  • any data, content, or AI output will be accurate, complete, current, or suitable for your circumstances
  • defects will be corrected
  • the Services will prevent losses, identify all risks, or improve your financial outcomes

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • FINQT AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • WE WILL NOT BE LIABLE FOR TRADING LOSSES, LOST PROFITS, LOST REVENUE, LOST OPPORTUNITY, LOSS OF GOODWILL, LOSS OF DATA, DEVICE DAMAGE, OR BUSINESS INTERRUPTION
  • OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.


20. Indemnity

You agree to defend, indemnify, and hold harmless Finqt and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • your use of the Services
  • your User Content or submitted materials
  • your violation of these Terms, our policies, or applicable law
  • your infringement or violation of another person's rights

21. Export Controls, Sanctions, and Compliance

You may not use the Services in violation of export-control, sanctions, anti-money-laundering, anti-corruption, or similar laws. You represent that you are not using the Services on behalf of, or for the benefit of, any person or jurisdiction subject to applicable embargoes or restrictions.

We may use platform, billing, location, session, or abuse signals to restrict access where reasonably necessary for compliance or risk management.


22. Governing Law and Dispute Resolution

These Terms and any non-contractual disputes arising out of or relating to them are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles.

The courts of Dubai, United Arab Emirates will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, except that either party may seek interim or injunctive relief in any court of competent jurisdiction to protect intellectual property, confidential information, or security interests.

Before filing a formal claim, you agree to contact us at [email protected] and attempt in good faith to resolve the matter informally.

You and Finqt agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, consolidated, representative, or private-attorney-general proceeding to the maximum extent permitted by applicable law. If a court determines that this sentence is unenforceable for a specific claim or remedy, that claim or remedy must be severed and the remainder of this section will remain in effect to the maximum extent permitted by law.


23. General Provisions

  • We may assign or transfer our rights and obligations under these Terms.
  • You may not assign these Terms without our prior written consent.
  • If any provision is held unenforceable, the remaining provisions will remain in full force.
  • Our failure to enforce any provision is not a waiver.
  • These Terms, together with the incorporated policies, form the entire agreement between you and Finqt regarding the Services.
  • Sections that by their nature should survive termination will survive, including sections concerning intellectual property, payments, refunds, disclaimers, limitation of liability, indemnity, compliance restrictions, and dispute resolution.
  • We may communicate with you electronically for legal, operational, billing, and policy purposes, and you agree that electronic notices satisfy any legal communication requirement except where law requires a different form.
  • Headings are for convenience only and do not affect interpretation.
